Im on a contract wih 3 and ive just been sent a new phone?

I thought id still be able to use my old phone but I tried putting a pay as you go sim in but it just said insert the correct sim, is there anthing I can do or is this phone useless now, could I get it unlocked? but if I did would I lose all my song and pictures and messages that are saved to the phone?
